The Madras High Court has permitted a woman to undergo an abortion after severe abnormalities were detected in her fetus. The Court observed that when a mother takes the heartbreaking decision not to give birth to a child due to fetal abnormalities, the Court should defer to that decision. Justice P.T. Asha stated in her judgment that a mother has the right to decide whether she wishes to bring such a child into the world, especially when the child would be unable to lead a normal life.
Justice Asha further added that the petitioner mother took this painful and final step considering the significant risks regarding the child's prospects of living a dignified and self-reliant life; therefore, the Court must accept this decision. The Court noted that it is the parents who bear the responsibility of witnessing the daily suffering of such a child. The parents took this decision so that the child would not have to be brought into this world to lead a life of indignity. Furthermore, an unborn child also has the right to a dignified life and should not become an object of ridicule. The Court also highlighted the need to consider the child's life after the parents' lifetime.
According to a report by The Hindu, the Institute of Obstetrics and Gynaecology and Government Hospital for Women and Children at Egmore, Chennai, had refused to perform the abortion on October 13, 2026. The proceedings issued by the hospital's chairperson stated that the medical board opined that the neurological abnormalities were not life-threatening, and therefore, an abortion could not be performed. However, the High Court has quashed this proceeding and ordered an immediate abortion, as the pregnancy had exceeded 24 weeks.
According to the case details, the petitioner woman and her husband had a son born in 2024, and this was their second pregnancy. The woman's trimester scan report revealed mild ventriculomegaly (dilation of the brain's ventricles due to accumulation of cerebrospinal fluid). To confirm this abnormality, the couple sought a second medical opinion, which also confirmed the condition.
Subsequently, when the woman underwent an ultrasound scan, the extended neurosonography report noted agenesis of the corpus callosum (a congenital cerebral defect) and bilateral moderate ventriculomegaly. Doctors informed the couple that fetuses with agenesis of the corpus callosum have an increased risk of developmental difficulties, including cognitive dysfunction, behavioural problems, difficulty in social interaction, epilepsy, and intellectual disability.
The couple was further informed that the exact extent of the impairment cannot be reliably predicted before birth. If there are additional cerebral or genetic abnormalities, the risk increases significantly. Considering all these severe circumstances, the couple decided to undergo an abortion. However, when the doctors refused to perform the procedure, they approached the court for judicial assistance.
